Terms of Service.
These terms apply to your use of creatornegotiator.com (the “site”), operated by Creator Negotiator LLC (“Creator Negotiator”, “we”, “us”). By using the site you agree to them. If you don’t agree, please don’t use the site.
1. What the site is
The site describes our creator representation and TikTok Shop growth services and lets brands and creators get in touch with us. Nothing on the site is an offer, quote or binding commitment. Any services we provide are governed by a separate written agreement, and if that agreement conflicts with these terms, the agreement wins.
2. Figures, results and examples
- Creator GMV figures on the site are referenced from Kalodata and other third-party or public data for the periods shown, and are refreshed periodically. They may differ from figures reported elsewhere and may change.
- Case studies and campaign examples describe past results for specific brands. They are not a promise or prediction of results for anyone else; TikTok Shop performance depends on many factors outside our control.
- Any commitments about videos, deliverables or timelines apply only as set out in a signed agreement.
3. Creators and roster
The roster shows creators we represent or work with. Availability, rates and terms for any creator are confirmed only when a deal is agreed. Showing a creator on the site does not guarantee they will take on a particular brand or campaign.
4. Your submissions
When you send us information through a form, WhatsApp or email, you confirm it is accurate and that you’re allowed to share it. If you apply as a creator, you confirm you are 18 or over. We handle your information as described in our Privacy Policy.
5. Acceptable use
You agree not to misuse the site, including by: sending spam or automated submissions; attempting to access systems or data you’re not authorised to; interfering with the site’s security or performance; scraping or copying site content in bulk; or using the site for anything unlawful or misleading.
6. Intellectual property
The site’s design, text, graphics and the Creator Negotiator name and logo belong to us and may not be copied or reused without our permission. Brand names and logos of companies we’ve worked with belong to their owners and are shown only to identify them. Creator images, handles and videos belong to the creators and/or TikTok and are shown with permission or as embedded content.
TikTok and TikTok Shop are trademarks of their respective owners. Creator Negotiator is an independent agency and is not affiliated with, endorsed by or sponsored by TikTok.
7. Third-party sites and content
The site links to and embeds content from third parties such as TikTok, WhatsApp, Facebook and Kalodata. We don’t control those services and aren’t responsible for their content, availability or practices. Their own terms and privacy policies apply.
8. Disclaimers
The site is provided “as is” and “as available”. To the fullest extent allowed by law, we make no warranties of any kind about the site, including that it will be accurate, complete, uninterrupted or error-free. Information on the site is general and isn’t business, legal or financial advice.
9. Limitation of liability
To the fullest extent allowed by law, we won’t be liable for any indirect, incidental, special or consequential losses, or for lost profits, revenue or data, arising from your use of (or inability to use) the site. Our total liability for any claim relating to the site is limited to USD $100. Nothing in these terms limits liability that can’t be limited by law.
10. Changes
We may update the site and these terms at any time. The date at the top shows when the terms last changed; continuing to use the site after a change means you accept the updated terms.
11. General
If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a right isn’t a waiver of it. These terms are the whole agreement between you and us about the site itself.
